1. Acceptance of Terms and Conditions of Use
1.1 By accessing any part of the Site, or using our services, you shall be deemed to have read & accepted these Terms and Conditions in full. If you do not accept these Terms and Conditions of Use in full, you must leave the Site immediately.
1.2 We reserve the right to change or update these Terms and Conditions of Use from time to time without prior notice. Revised Terms and Conditions of Use will be published on this Site.

2. Copyright and Other Intellectual Property Rights
2.1 All rights are reserved. Your use of the Site grants no rights to you in relation to copyright, trade marks or other of our intellectual property rights or the intellectual property rights of third parties.
2.2 You may not, without limitation, copy, reproduce, republish, adapt/change, download, post, broadcast, record, transmit, commercially exploit, sell, perform/deliver, communicate to the public, or otherwise use the content included in or provided via the Site except for your own personal, non-commercial use or where we expressly give you a right to do so on a case-by-case basis. Any unauthorised use or attempt by individuals or organisations to pass this work off as their own constitutes an infringement of copyright.

3.Information on the Site
3.1 To the best of our knowledge all information on this Site is correct. As we are constantly seeking to improve the site and its content, we may change any aspect of the Site, its content, features or services at any time.

4. Limitation of Liability
4.1 Whilst we will use all reasonable endeavours to correct any errors or omissions as soon as is practicable once they have been brought to our attention, we do not warrant that the Site will be available uninterrupted and in a fully operating condition, nor that the information on and provided via the Site will be free from errors or omissions.
4.2 Access to this Site and its contents may be suspended temporarily and without notice in the case of system failure, necessary maintenance or repair or for reasons beyond our control.
4.3 Save that nothing in this paragraph 4 shall restrict your statutory rights (including your rights to receive a reasonable standard of service) all content, features and services on this Site are provided on an 'as is' and 'as available' basis. We do not make any representation or give any warranty in respect of the Site or its content, including, without limitation, any advice and information given (on a personal or general basis).

Such links are provided for your reference and convenience only. We do not control such websites and are not responsible for their contents. In particular, you acknowledge that we will not be party to any transaction or contract with a third party that you may enter into and that we shall have no liability to you in respect of any such transaction, whether arising in contract, tort, under statute or otherwise.
4.6 We will not be liable for any damages, including indirect or consequential losses and whether in contract, tort (including negligence) or otherwise, arising in connection with a breach of these Terms and Conditions by you or any other user or visitor to the Site or that is not directly attributable to our negligence. Where we are liable for direct loss this will be limited to a maximum of the total price of the products or services acquired or provided via the Site in respect of which a claim is made or the sum of £100 whichever is the lesser.
4.7 Nothing in these Terms and Conditions of Use shall exclude or limit our liability for fraudulent misrepresentation or death or personal injury caused by our negligence.

5. Denial of Access
5.1 We reserve the right to suspend, restrict or terminate your access to the Site at any time without notice for any reason.

6. Competitions, Offers and Promotions
6.1 Each competition, offer or other promotional features available through this Site may have specific terms and conditions. You will need to read and accept these before making a submission.

7. Data Processing and Privacy
7.1 Your personal details, or those of any friends or colleagues that you refer, will never be given or sold to anyone else.

8 Refunds
8.1 We're so confident in our programmes that we offer a money back guarantee.  If, after the first 30 days of the programme, you are not totally happy, simply write to us within the next 7 days to request an instant refund.  We will refund all fees paid (minus our irrecoverable expenses).

9. Booking Conditions
9.1 All cancellations must be made in writing.
9.2 Cancellations may be made at any time up to eight weeks before the date of the event (or alternative cancellation date specified on your booking confirmation form) at no charge; cancellations made after this time will incur the full fee.
9.3 Substitutions of one learner for another from the same school or college can be made at any time prior to the programme beginning without penalty; after this places are non-transferable.
9.4 We reserve the right to amend the programme, date, timing, content, speakers and/or venue in circumstances beyond our control.  If the event is cancelled, no liability is assumed by Kudos for any costs incurred by learners in connection with their attendance.
9.5 A 25% deposit is required within 7 days of booking to secure dates & you must ensure that your programme is scheduled to be completed within 12 months of your booking.  After this period our contract expires and we will need to make an additional charge and/or cancel any remaining sessions.
9.6 Flexible payment terms are available for the balance - please contact us to discuss options
9.7 Payment must reach our account within 30 days of being presented with an invoice from us.  We appreciate clients that pay on time and our fees reflect this.  In accordance with Late Payment Legislation, if your payment is received after the "due date" we reserve the right to charge a Late Payment Penalty + statutory interest.
9.8 Please note that all bookings are taken in good faith.  Where you are booking on behalf of your school or college, it is your responsibility to ensure that you have permission from them before placing your order, as this will enter you into a firm contract with Kudos.

10. General
10.1 We shall not be liable for any failure for any suspension, or termination of access to the Site or any content arising out of a force majeure event. A force majeure event shall include, without limitation, failure of infrastructure, government intervention, wars, civil commotion, hijacking, fire, flood, accident, storm, strikes, lockouts, terrorist attacks, or industrial action affecting our associates, our suppliers, or us.
10.2 If any of these Terms and Conditions are determined to be illegal, invalid or otherwise unenforceable by reason of law then to the extent and within the jurisdiction in which that term is illegal, invalid or unenforceable, it shall be severed and deleted from these terms and the remaining terms shall survive, remain in full force and effect and continue to be binding and enforceable.
10.3 These terms shall be governed by and interpreted in accordance with the laws of England. Disputes arising in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
